Terms of Service
These terms explain how Whitlock Capture provides remote photo processing and digital image preparation. They cover project scope, pricing, payment, digital delivery, corrections, cancellations and refunds. Please read them before agreeing to a paid project.
1. Who we are and what these terms cover
Whitlock Capture is a photo processing business founded on September 30, 2026. Services are provided remotely to individuals, photographers and small businesses. Clients supply digital images online, and completed files are delivered electronically. Our business contact details appear at the end of this document.
These terms apply to use of our website and to services purchased directly from Whitlock Capture. A written project confirmation may specify the image count, required adjustments, output formats, delivery schedule and any special conditions. Those project-specific details define the work we agree to perform. Mandatory rights under applicable law remain unaffected.
2. Website requests and project acceptance
The website request form currently displays an acknowledgement within the browser. It does not transmit the entered information, upload images, create a binding paid order or take payment. A visible acknowledgement is not confirmation that work has been accepted or scheduled. Contact us using the email shown below to arrange an actual project.
A paid project begins only after we have reviewed the requirements and both parties have agreed to the scope, price and any payment conditions in writing. We may decline a request that falls outside our services, cannot be completed responsibly, lacks sufficient source material or involves content that we cannot lawfully process.
3. Services and scope of work
Our services include Basic Photo Enhancement, Background Removal & Cleanup, Color Correction & Adjustment, Product Image Preparation, Portrait Photo Retouching, Catalog Image Standardization, Image Resizing & Web Optimization and the Batch Photo Processing Package. The selected service and agreed brief determine the changes included.
Basic enhancement and batch processing cover ordinary exposure, colour and crop adjustments. They do not automatically include extensive reconstruction, complex compositing or advanced portrait work. Background services require clear instructions about transparency, background colour and retained shadows. Catalogue work requires agreed dimensions, proportions and presentation rules.
Portrait retouching is intended to preserve natural texture while correcting agreed distractions. An edit cannot restore detail that does not exist in the source image. Large enlargements, heavily compressed files, severe blur and difficult lighting may limit the result. We will discuss known limitations before accepting work when they are apparent.
4. Client information and source images
Provide the original files, accurate instructions and any relevant references through the transfer method agreed for the project. Specify the intended use, dimensions, export format, cropping preferences and details that should remain unchanged. Keep your own copies of source files and reference materials.
You are responsible for ensuring that supplied files are usable, free from malicious content and within any agreed technical limits. If files are incomplete, corrupted or inconsistent with the agreed brief, work may pause while replacements or clarification are obtained. Delivery estimates may be revised accordingly.
Do not include identity documents, account credentials or unrelated sensitive information in a routine photo processing request. If a project contains information requiring special handling, discuss that requirement before transferring any files.
5. Rights, permissions and acceptable use
You must own the supplied images or hold permission to have them processed, reproduced and used for the intended purpose. You are responsible for obtaining any required consent from photographers, depicted individuals, copyright holders and other rights owners. Uploading a file does not transfer ownership to us.
You authorise Whitlock Capture to access, copy and modify the supplied files only as reasonably necessary to provide the agreed service and resolve related quality issues. We do not receive a general right to publish your images, use them in advertising or present them as our own portfolio work. Separate permission is required for such uses.
Do not request unlawful edits, infringing content, deceptive document alterations or processing that violates another person’s privacy or rights. We may stop work where a rights issue or unlawful purpose becomes apparent. We will explain the reason where doing so is lawful and reasonably practical.
6. Published prices and package limits
Prices are quoted in United States dollars. The listed per-image rates are: Basic Photo Enhancement $4; Background Removal & Cleanup $3; Color Correction & Adjustment $4; Product Image Preparation $5; Portrait Photo Retouching $9; and Catalog Image Standardization $4.
Image Resizing & Web Optimization is $39 for one package of up to 20 images. The Batch Photo Processing Package is $129 for one package of up to 40 images. A package covers the specified type of processing; it does not include every service for each image. Unused capacity within an accepted package does not automatically create a credit or entitlement to unrelated services.
Additional files, multiple edits to the same image or unusually complex requirements must be scoped before work begins. Any additional fees and applicable taxes will be disclosed in the written quote. We will not silently add services or charge a different total after you have accepted a quote. Price changes apply to future quotes unless both parties agree otherwise.
7. Payment and billing
The website request form does not collect payment details. Payment method, due date, any deposit and the timing of the balance will be stated in the accepted written quote or invoice. There are no automatic recurring charges under these terms. Do not send complete card numbers, banking passwords or authentication codes through the request form or ordinary email.
Work may be scheduled after any agreed initial payment has cleared. Payment delays can change the start date or delivery estimate. Any payment processing or currency conversion charges imposed by your own provider are separate from our quoted service price unless the accepted invoice states otherwise.
If you believe an invoice contains an error, contact us with the invoice reference and a description of the issue. We will review the billing record and correct an established error. These terms do not restrict lawful payment dispute rights.
8. Electronic delivery and timing
All services are digital. There are no physical goods, shipping charges or in-person collection requirements. The completed image files will be supplied electronically using the delivery method agreed for the project. The export format, dimensions and naming rules will follow the accepted brief.
A delivery estimate depends on source file quality, image count, processing complexity and availability. No standard same-day or fixed-hour turnaround is promised on this website. We will communicate the expected schedule before accepting paid work and inform you if a material delay becomes apparent.
Delivery is made to the email address or transfer destination agreed with you. Check that you can access the files, notify us promptly of any broken link or missing item, and download a copy for your own storage. A temporary transfer link is not a permanent archival service. Any access expiry will be explained with the delivery instructions.
9. Review, corrections and changes to the brief
Review the delivered images against the accepted brief and describe any specific discrepancy, identifying the affected filenames and requested correction. Where our processing does not match the agreed instructions, we will review the issue and provide a reasonable correction without charging for the same work again.
A new creative direction, additional images, a different crop, newly requested dimensions or extra services outside the original brief may require a separate quote. We will distinguish an in-scope correction from a new request before proceeding. Screen settings and display conditions can affect the appearance of colour; supply relevant technical requirements when colour consistency is critical.
Please report concerns as soon as reasonably possible so the relevant files and instructions can be reviewed. No short notice period in these terms removes rights you may have under applicable consumer law.
10. Cancellations, returns and refunds
A request that has not become an accepted paid project can be withdrawn without a service charge. If you cancel an accepted project before processing begins, any prepaid fee for unperformed work will be refunded. If work has already begun, we will identify the work completed and discuss the unperformed portion; any amount retained must reasonably relate to authorised work already performed.
Because the deliverables are digital files rather than physical goods, there is no physical return shipment. If a paid service is not delivered, or materially fails to match the accepted brief and a reasonable correction cannot resolve the issue, we will provide an appropriate refund for the affected service or unperformed portion. A refund is not excluded simply because the work is digital.
Refund requests should include the project or invoice reference, affected filenames where relevant, and the reason for the request. Approved refunds are returned using the original payment route where possible. The expected processing time will be communicated after approval and may depend on the payment provider. Statutory cancellation, refund and other consumer rights prevail over these terms wherever applicable.
11. Confidentiality and file handling
Source images, instructions and completed files are treated as project materials. Access should be limited to people and service providers who need it to perform the work, support delivery, maintain systems or comply with legal obligations. Material is not made public merely because it was supplied for editing.
The Privacy Policy describes how personal information is handled. Retention depends on the project purpose, any ongoing corrections and applicable recordkeeping duties; permanent storage of source or output files is not included in the service. Ask about specific confidentiality, deletion or transfer requirements before accepting the quote.
12. Responsibility and service limitations
We will exercise reasonable care in carrying out the accepted work. Results depend partly on the source images and the clarity of the brief. We do not promise improved sales, platform approval, publication acceptance or a particular commercial outcome from processed images.
You remain responsible for how the completed images are used, the accuracy of the claims attached to them and compliance with the requirements of your chosen publishing platform. Nothing in these terms excludes liability that cannot lawfully be excluded, or limits any mandatory remedy for an affected consumer.
13. Changes, applicable law and resolution
We may update these terms when services, website features or legal requirements change. The effective and last updated dates show the version currently posted. For an accepted project, the version agreed when the project was confirmed applies unless a later change is required by law or accepted by both parties.
These terms are governed by the laws applicable to the business in Colorado, United States, subject to any mandatory consumer protections and jurisdiction rules that apply to you. If a concern arises, contact us first with the relevant project information so we can seek a practical resolution. These terms do not impose mandatory arbitration or prevent you from using lawful complaint or court procedures.
